Mishpatim of Zohar

Originally written down in the 2nd century, the Zohar (“Illumination”) which, as printed and packaged today fills twenty-two hardbound volumes plus an Index volume, is the 13th century publication of what had been mystical and strictly esoteric oral teachings—high commentary on the Torah—revered by Kabbalist rabbis who, until relatively recent years, had exclusive access. In 2001, it was published in the English language, side-by-side with the original Aramaic, for the very first time, and it is now available to all English-speaking men as well as women.

The Mishpatim (mish-pa-teem’) portion of the Zohar elucidates the corresponding “Book of the Covenant” portion of the Torah, and, as an exegesis, it is revelatory and explanatory with respect to the Creator’s intent regarding the societal governance deemed necessary in the persistent absence of human willingness to follow the One Law, which Jesus of Nazareth reintroduced as an 11th Commandment to subsume the Ten delivered by Moses. The Zoharic Mishpatim, in carrying the root Source spirit of the Mosaic code of law, the spirit of the Torah’s “Covenant Code,” stresses the inescapability of certain judgments. Found in Zohar Volume 10, it is cornerstone to the structure of the entire Western legal system, including the USA’s, while other codes such as Urukagina’s (Sumeria), Hammurabi’s (Babylonia), and Manu’s (Eastern/India) have had some influence—as found resonant/compatible in shaping the unfolding schema of Western Law—and are countable among the numerous lesser foundation stones. No legal opinion or court adjudication can be integrous with the Covenant if it runs contrary to the foundational essence of law expressed via this ancient sourcebook.

While there are many sources of information about Mishpatim available, our purpose here is: (1) to concentrate on our observation that, despite its extreme significance and importance in all legal matters, the Mishpatim portion of Zohar is practically unknown among Juris Doctors in the USA and elsewhere and (2) to work toward rectification of this oversight. To that end, the following paragraphs will highlight a few key parts of Mishpatim and discuss the effect on our society of breeching requirements expressed therein. It must be stressed that although “the letter” of the Torah was most pragmatically pertinent to those appointed to dwell in a certain place in Space and Time, for certain purpose, the spirit of Zoharic Mishpatim is globally overshadowing, timeless, and transgenerational, a product of higher non-mortal Consciousness.

Encrypted by kabbalistic elements and metaphors and established within the context of the culture in which it was received, the strange language of the mystical Zoharic commentary on the Torah’s Mishpatim prevents the uninitiated who—despite wisdom, lack understanding—seek to fully extract the powerful insights it contains. However, much of the material would be clear and definite for almost any reader, and it is this information that we can share with expectation of evoking minimal controversy. Fortunately, this is also the information that we see as having greatest value now for students and practitioners of law as well as everyone else.

A prime example is the relatively plain language statement in paragraph 407 of the Zohar’s illumination of Mishpatim: “Truth prevails; falsehood cannot, as it must become void. As such he [the liar] has demolished the structure and caused the fall of heaven and earth.” Note that it does not say that truth will prevail; it says: “truth prevails” because the perspective is from beyond ordinary Time. Its view is across human incarnations, and it sees judgment arising automatically, alongside the lie, independently of human verdict. Yet correct and just action of a court is no less important—in fact, it is more important day-to-day—because a government-sanctioned judgment that favors a lie conjoins the liar (and his advocate/s), and automatic judgment is then upon both the liar and the court together with the liar’s attorney/s, with impacts on society that are destructive even when not immediately detected.

One may conclude that, regardless of injustice, everything works to the good. Yes, over generations, but in the meantime the meta-structure—the higher vision—of heaven and earth is “demolished” yielding dire consequences in the lower world of mortals. In the USA and elsewhere, we have witnessed and continue witnessing the socio-economic effects of allowing parasitic world-class liars, thieves, and cheats to systematically harvest the fruits of labors of the masses of people while blaming the host. Systemic evils of the banking industry, for example, although plainly visible since the 1980s, have become blatant in this century as the abuses are backed and rewarded more so than curtailed by government. Comparison of the state of affairs in the USA today to the Fall of Rome is easily made, and yet liars, thieves, and cheats are permitted to prosper as if right judgment is permanently avoidable by corrupt human mandate.

Similarly, and associated with the foregoing Mishpatim declaration, paragraph 408 states the admonition that: “He who swears falsely [who gives false testimony or brings fraud before a court] causes the downfall of heaven and earth.” If such claimed effect seems an exaggeration, reflect on the state of the world as it is and consider what it would be like without liars, thieves, and cheats. Focus your thoughts and feelings on the latter, on your desires, because this strengthens the resolve of collective consciousness. Further on we read: “The structure of heaven and earth is based on truth.” Nothing of value is based on lies, or worse: on entrained delusion that seems normal and supports the ever-lowering of positive expectations. Sandcastles epitomize temporal foolishness, but at least they support visions of possible grandeur.

A judge who renders an untruthful verdict engages in an act equivalent to giving dominion of the world to the highest powers of death and destruction because unrighteous judgment has as monstrous an effect on society as inviting an invasion by Genghis Khan. Nor does the judge escape that effect. Paragraph 429 says: “You shall not follow a multitude to do evil [or] to incline a multitude to pervert justice… A judge that does not render a truthful verdict… encourages falsehood… Keep you far from a false matter…” This is further elucidated in paragraphs 436 and 437 as meaning: the judge is to be like the “One” and that this can only be achieved in the absence of bias, favoritism, and self-interest. Neither plaintiff nor defendant is to be unevenly empowered in the process of reaching a judgment. In part, this means that a judge must not be swayed by deceptions, unjust precedents, or common holdings of corrupt courts; his/her role is not equivalent to referee in a sports event.

For example, in the wake of the USA’s “housing bubble” that burst beginning in 2006, devastating the economy, literally millions of wrongful foreclosures have been and continue to be processed through the courts as predatory lenders and their agents routinely bring fraudulent claims, falsified documents, and unethical testimonies before them while homeowners lacking knowledge and/or funds to defend themselves are made homeless by the State. This occurs when judges fail to disallow it. “Earth can survive only with law; without law, the world cannot survive, so consequently the world was created with law and so it survives” (paragraph 517). But, again, that survival—personally, nationally, globally—relies on righteous judgment by governmental judges and by citizens. Therefore, “All things I have said to you be mindful of” (paragraph 541). The consequences are dire.

While NoetiTaoism™ finds flaws in the Torah and Zohar, the above-cited material is compatible, including paragraph 418: “Know what is above you—a watchful eye, an attentive ear, and [know that] all your deeds are recorded in a book.” The infinite Consciousness that permeates the lower dimensions of Omniverse sees everything, forgets nothing, and maintains equity across Time. When necessary, reincarnation plays a default role. It is more than simple coincidence that the holy sanctuary described is made from sapphire stone (paragraph 579) and that, more than twenty years ago, Noetitek™ identified the central dimension of Omniverse—the seed of the omniversal sphere, correspondent with the “parietal eye” of the human brain—as a place where Time effectively stands still,” where Time is transcended, and this dimension is associated with the color blue (see the May, 2012 post: “The Color of Time”).
